يعاقب بالاشغال المؤقتة من هتك عرض انسان لا يستطيع المقاومة بسبب عجز جسدي أو إعاقة
جسدية أو نفسية أو ذهنية او بسبب ما استعمل نحوه من ضروب الخداع او حمله على ارتكابه.
