Article text
أ- ينظم عقد التأمين كتابة على أن يتضمن الشروط والأحكام العامة والخاصة والتغطيات
والاستثناءات والبيانات التالية حدا أدنى: -
1 - أسماء المتعاقدين وعناوينهم.
2 . - اسم المستفيد وعنوانه، إن وجد
3 . - محل العقد ويشمل الشيء أو المال أو الشخص المؤمن عليه أو المصلحة المؤمن عليها
4 . - طبيعة المخاطر المؤمن منها أو ضدها
5 . - تاريخ إبرام العقد، وتاريخ سريانه ووقته ومدته
6 . - مبلغ التأمين أو منافعه
7 . - قسط التأمين
8 . - المدة التي يجب خلالها التبليغ عن تحقق الخطر
9 . - توقيع الطرفين أو من يمثلهم قانونا
10 . - أي بيانات أخرى تقتضيها أحكام هذا القانون والتشريعات ذوات العلاقة
ب- يجب أن ينظم عقد التأمين بشكل واف وأن تكون عبارات العقد واضحة وبسيطة، وفي حال
غموضها يتم تفسيرها لمصلحة المؤمن له.
