Article text
أ- يجوز أن يتضمن عقد التأمين البحري إضافة إلى الشروط العامة والخاصة الواردة فيه أي شروط
صريحة أو ضمنية يلتزم المؤمن له بمقتضى كل منها بأداء عمل أو الامتناع عن عمل.
ب- إذا خالف المؤمن له أيا من الشروط المنصوص عليها في الفقرة (أ) من هذه المادة، أعفي
المؤمن من مسؤوليته من تاريخ تلك المخالفة ما لم يقبل صراحة أو ضمنا بها، فإذا قبل بها فلا
يجوز له الرجوع عن هذا القبول.
ج- لا يعفي المؤمن من مسؤوليته إذا أصبح أي من الشروط المنصوص عليها في الفقرة (أ) من
هذه المادة غير قابل للتطبيق بسبب تغير ظروف عقد التأمين أو إذا كان من شأن تطبيق هذا
الشرط مخالفة التشريعات النافذة.
