أ- يجب أن يكون الاشتراط الصريح منصوصا عليه في عقد التأمين أو أن يتضمنه مستند يشار إليه
في العقد شريطة تزويد المؤمن له بهذا المستند.
ب - إذا تعارض الاشتراط الضمني مع الاشتراط الصريح يطبق الأخير.
