Means and Mechanisms for Implementing Alternatives to Custodial Sentences Regulation No. 46 of 2022

لغايات الحكم بأي من بدائل العقوبات السالبة للحرية تتبع الإجراءات التالية:-
أ- تكلف المحكمة ضابط الارتباط بإعداد تقرير الحالة الاجتماعية وفق النموذج المعد لهذه الغاية
وتزوده بملف القضية .
ب- يقوم ضابط الارتباط بإعداد تقرير الحالة الاجتماعية متضمناً التنسيب ببديل أو اكثر من بدائل
العقوبة السالبة للحرية ويرفعه للمحكمة.
ج- تصدر المحكمة قرارها ببديل العقوبة السالبة للحرية وفقا لأحكام القانون.
د- تصدر المحكمة مذكرة بديل عقوبة سالبة للحرية بحق المحكوم عليه تتضمن تفاصيل
الحكم اذا كان الحكم وجاهيا، ومذكرة إعلام حكم اذا كان الحكم بمثابة الوجاهي.
