Article text
أ- يحق للمؤمن له أو للمستفيد من عقد التأمين الانتفاع من شرط الاختراق، ولا يجوز لأي جهة
الاعتراض على تفعيله.
ب- لغايات تطبيق أحكام الفقرة (أ) من هذه المادة، يقصد بشرط الاختراق الشرط الوارد في عقد
إعادة التأمين والذي يقضي بمسؤولية معيد التأمين في حدود حصته من الخسارة المعاد
تأمينها لديه تجاه المؤمن له والمستفيد في الحالات التي يتعذر على المؤمن الوفاء بالتزاماته
تجاه المؤمن له أو المستفيد كتصفية شركة التأمين وبحيث تنشأ علاقة مباشرة بين معيد
التأمين والمؤمن له والمستفيد.
