Article text
( يعاقب بالحبس مدة لا تزيد على ثلاث سنوات أو بغرامة لا تزيد على 5000 ) خمسة آلاف دينار أو بكلتا
هاتين العقوبتين مع إلزامه برد الأموال التي حصل عليها من ذمة الإعسار كل دائن للمدين قام
بما يلي:-
أ- تعمد المبالغة في قيمة الديون المستحقة له على المدين أو طالب بديون وهمية باسمه أو
باسم شخص ثالث بزعمه أنها مستحقة في ذمة الإعسار .
ب- اشترك في المداولات والتصويت على إعادة التنظيم مع علمه بأنه ليس مخولا بذلك.
ج- تعمد إبرام تصرف مع المدين قبل إشهار الإعسار للحصول على امتيازات خاصة بشكل يضر
بالدائنين الآخرين.
د- أبرم عن قصد تصرف مع المدين بعد إشهار الإعسار للحصول على امتيازات خاصة بشكل يضر
بالدائنين الآخرين وفي هذه الحالة على المحكمة أن تحكم من تلقاء ذاتها بعدم نفاذ التصرف
وبالتعويض بناء على طلب الجهات ذات العلاقة.
