Article text
أ- تختص المحكمة بالنظر في إجراءات الإعسار بناء على الطلبات التي يقدمها الخصوم، ولها
من تلقاء ذاتها أن تنظر تدقيقا في أي مسائل أو طلبات تتعلق بإجراءات الإعسار إذا رأت ذلك
ضروريا.
ب- تختص المحكمة بالنظر في أي مسائل تتعلق بتطبيق أحكام هذا القانون وفي أي دعاوى أو
طلبات تؤثر على ذمة الإعسار، بما في ذلك ما يلي:-
1 - القضايا التنفيذية .
2 . - أي إجراءات تحفظية تتعلق بأموال ذمة الإعسار
3 . - دعاوى عدم نفاذ تصرفات المدين
4 - الدعاوى المتعلقة بمسؤولية المدين والأشخاص الذين
. يتولون إدارته و مدققي حساباته
5 - الدعاوى المتعلقة بقبول طلبات تسجيل ديون الدائنين
. أو الاعتراض عليها
6 - الدعاوى المقامة لتعديل أو إنهاء العقود الجاري
. تنفيذها وعقود العمل وفقا لأحكام هذا القانون
ج- لا تختص المحكمة بالنظر في الدعاوى المقامة من
المدين إلا في الحالات المنصوص عليها في الفقرة (ج)
( من المادة 21 ) من هذا القانون.
