Article text
لا يجوز للمدين أو وكيل الإعسار بيع أموال ذمة الإعسار أو التصرف فيها خلال المرحلة التمهيدية،
ويستثنى من ذلك ما يلي:-
أ - التصرفات الجارية ضمن العمل المعتاد.
ب - بيع الأموال التي تعتبر ضرورية لاستمرار النشاط
الاقتصادي أو للحصول على السيولة اللازمة لاستمراره في
حال تعذُر الحصول على الائتمان.
ج- بيع الأموال التي لا تعتبر ضرورية لاستمرار النشاط
الاقتصادي إذا جرى بيعها بسعر السوق وإذا كانت أموالا غير
( منقولة يجب أن لا يقل ثمن بيعها عن 90 % ) من ثمن
المثل.
د- يجوز بيع جزء من النشاط الاقتصادي في أي وقت خلال المرحلة التمهيدية شريطة مراعاة ما
يلي:-
أن يكون من غير المحتمل أن يؤثر البيع سلبا على فرص إعادة تنظيم باقي النشاطات وهيكلة
النشاط الاقتصادي بشكل جوهري.
أن يكون السعر المعروض مساويا لسعر السوق.
هـ- باستثناء ما ورد في الفقرة (أ) من هذه المــادة يجب الحصول على موافقة مسبقة من
المحكمة على إجراء التصرفات المنصوص عليها في هذه المادة وللمحكمة أن تستمع لأقوال
لجنة الدائنين وممثلي العاملين لدى المدين.
