( أ- مع مراعاة أحكام الفقرة )أ( من المادة 38 ) من هذا القانون تعتبر الديون التالية ديوناً ممتازة
لغايات أحكام هذا القانون و حسب الترتيب التالي :-
أجور العاملين لدى المدين ومستحقاتهم الناشئة عن إنهاء عقود العمل وبحد أعلى أجور ثلاثة
أشهر.
نفقة الزوجة والأولاد والوالدين والأقارب المستحقة على المدين من الأشخاص الطبيعيين قبل
إشهار الإعسار.
المطالبات بالتعويض الناشئ عن الفعل الضار الذي تسبب به المدين قبل إشهار الإعسار.
ب- على الرغم مما ورد في أي تشريع آخر لا تعتبر أي ديون خلاف الديون المبينة في هذه المادة
ديوناً ممتازة.
