تعتبر الديون التالية الأدنى في مرتبة الأولوية من أي ديون أخرى:-
أ- دفعات القروض أو التسهيلات الممنوحة للمدين من أحد الأشخاص ذوي الصلة .
ب- فوائد وغرامات التأخير المستحقة على الديون قبل تاريخ إشهار الإعسار .
ج- الغرامات المتحققة على المدين بموجب التشريعات النافذة.
د- الديون التي اتفق المدين مع الدائن على اعتبارها ديوناً أدنى في مرتبة الأولوية.
