Article text
أ- تتولى المحكمة من تلقاء ذاتها أو بناء على طلب وكيل الإعسار الإعلان عن تاريخ اجتماع
الهيئة العامة للدائنين ووقته ومكانه وجدول أعماله قبل أسبوع على الأقل من موعد انعقاده
( وفقاً لأحكام المادة 139 ) من هذا القانون .
ب- يترأس اجتماع الهيئة العامة للدائنين وكيل الإعسار ما لم يقرر قاضي المحكمة ترؤس
الاجتماع بنفسه.
ج- يكون نصاب اجتماع الهيئة العامة للدائنين قانونيا بحضور دائنين يمثلون أصالة أو وكالة
( 50 ) على الأقل من إجمالي الديون واذا لم يكتمل هذا النصاب خلال ساعة من الوقت المحدد %
لبدء الاجتماع فيؤجل الاجتماع الى موعد آخر يعقد خلال مدة خمسة أيام من التاريخ المحدد
للاجتماع الاول ويعاد تبليغ الدائنين الذين لم يحضروا.
( د- يكون النصاب في الاجتماع الثاني قانونيا بحضور دائنين يمثلون أصالة أو وكالة 35 ) على %
الأقل من إجمالي الديون على ألا يقل عدد الدائنين الحاضرين عن ثلاثة دائنين.
