Article text
أ- يتم تسجيل الديون خطياً عن طريق تقديم طلب تسجيل الدين من الدائن مرفقاً به الوثائق
المعززة له خلال مدة ثلاثين يوماً من نشر قرار الإعسار وفقاً لأحكام هذا القانون.
ب- يتضمن طلب التسجيل اسم الدائن وموطنه أو مقره المسجل وأي معلومات لازمة للتعريف
به وعنوانه وعنوان بريده الالكتروني للتبليغ ان وجد إضافة للمعلومات المتعلقة بدينه خصوصا
أصله ومقداره وتاريخ نشوئه وتاريخ استحقاقه وطبيعته إضافة إلى تصنيفه وفقا لقواعد الإعسار
حسب رأى الدائن و إذا كان الدين مضمونا فيجب أن يتضمن الطلب وصفا للضمانة والبيانات
المدرجة في السجل الذي تم تسجيل أو إشهار الحق في الضمانة فيه.
ج- يرفق الطلب بالوثائق المعززة له، وللدائن تقديم صور عن تلك الوثائق على أنه يحق لوكيل
الإعسار طلب أصل تلك الوثائق إذا رأى ذلك ضروريا.
د- تعامل الديون التي لم تحل آجالها على أنها ديون مستحقة لغايات تسجيلها.
