أ- للمدين تفادي وضع الإعسار الوشيك من خلال اتفاق مع دائنيه يتم التوصل له خارج إجراءات
المحكمة أو في المراحل المبكرة لإشهار الإعسار على أن يتم ذلك بموافقة المحكمة.
ب- للمدين أن يتوصل مع دائنيه لتسوية تأخذ شكل خطة إعادة تنظيم معدة مسبقاً بهدف
ضمان أعلى نسبة سداد لديونهم واستمرار النشاط الاقتصادي بحيث يتم ذلك من خــلال :-
( إرفاق مقترح خطة بطلب إشهار الإعسار مرفقاً بموافقة خطية من دائنين يمثلون لـ 25 ) على %
الأقل من إجمالي الديون .
التقدم للمحكمة بمقترح للخطة خلال مدة ثلاثين يوما من تاريخ نشر قرار إشهار الإعسار.
