Article text
أ- يعد وكيل الإعسار تقريرا يتضمن تقييما شاملا لمقترح الخطة الذي قدمه المدين على أن
يستكمل التقرير ويكون قابلا للمناقشة مع الدائنين خلال مدة ثلاثين يوما من تاريخ تقديم
المقترح إذا تم إرفاقه بطلب إشهار الإعسار وخلال مدة عشرة أيام من تاريخ تقديمه للمحكمة إذا
تم بعد الطلب.
ب- يجب أن يتضمن التقرير المنصوص عليه في الفقرة (أ) من هذه المادة المسائل المنصوص
( عليها في المادة 78 ) من هذا القانون.
ج- لوكيل الإعسار أن يطلب من المدين أو من الدائنين الذين وافقوا على الخطة تزويده بأي
معلومات أو إيضاحات يراها مناسبة لغايات إعداد التقرير.
د- لوكيل الإعسار أن يطلب من المحكمة تعيين خبير لتقييم الخطة على أن يكون طلبه مبررا
وأن يحدد بوضوح المسائل الواردة في الخطة المطلوب الخبرة عليها.
