Article text
( أ- إذا وجدت المحكمة ان الطلب موافق للشروط المنصوص عليها في المواد 6 ) ( و 7 ) ( و 8 ) من
هذا القانون وثبت لها وفقا للبينات المرفقة به أن المستدعي معسر فتصدر قرارا بإشهار إعسار
المدين خلال مدة ثلاثين يوماً من تاريخ تقديم الطلب دون الحاجة لاتخاذ أي إجراءات أخرى.
( ب- إذا وجدت المحكمة أن البينات المقدمة من المدين في الطلب مخالفة لأحكام المادة 8 )
من هذا القانون فتمنح المدين مهلة خمسة عشر يوماً لاستكمالها وإذا لم يمتثل المدين لأمرها
فتقرر رد الطلب.
