Article text
أ- على المدين تضمين طلب إشهار الإعسار إقرارا منه بأنه دخل في مرحلة الإعسار الوشيك أو
الإعسار الفعلي حسب مقتضى الحال.
ب- ترفق بالطلب البينات التالية:-
1 - تقرير يتضمن أسباب الإعسار وتحليلا لمستقبل النشاط
. الاقتصادي
2 - شهادة صادرة عن جهة تسجيل المدين تبين تاريخ
. تسجيله وتسلسل أي تغييرات حاصلة عليه
3 - القيود المالية والمحاسبية للمدين بما في ذلك
الميزانية والبيانات المالية أو الدفاتر التجارية للسنوات
المالية الثلاث التي تسبق تقديم الطلب.
4 - كشف بالأموال المنقولة وغير المنقولة العائدة
للمدين مع بيان قيمة كل منها، وموقعها والمعلومات
المتعلقة بها وفقا للسجلات الرسمية وما إذا كانت هذه
الأموال خاضعة لإجراءات تنفيذ عليها أو موضوعة تأمينا
لدين أو انها موضوع حق امتياز مع بيان قيمة الديون
المترتبة عليها.
5 - قائمة بدائني المدين تتضمن اسم كل منهم وعنوانه،
إن وجد، ومبلغ دينه وأصل ذلك الدين وتاريخ نشأته
واستحقاقه.
6 - قائمة بمديني المدين تتضمن اسم كل منهم
وعنوانه، إن وجد، ومبلغ الدين المستحق له وأصل ذلك
الدين وتاريخ نشأته واستحقاقه.
7 - كشف بالإجراءات القضائية المقامة من المدين أو
. عليه
8 - أي بينات أخرى متعلقة بالطلب.
