Article text
أ- على المشرف على تنفيذ خطة إعادة التنظيم أو أعضاء لجنة الدائنين أو أي دائن إشعار
المحكمة فور علمهم بحصول إخلال جوهري بالخطة والطلب منها اصدار قرار بعدم التزام المدين
بالخطة ويعتبر عدم سداد أي قسط من الأقساط المنصوص عليها في الخطة إخلالا جوهريا بها.
ب- تبلغ المحكمة المدين بالطلب المنصوص عليه في الفقرة (أ) من هذه المادة و عليه أن
يقدم دفوعه خلال مدة خمسة أيام من تاريخ تبلغه.
ج- يترتب على قرار المحكمة بتأكيد وجود إخلال بخطة إعادة التنظيم البدء في مرحلة التصفية.
د- يكون القرار الصادر عن المحكمة قابلا للاستئناف خلال مدة عشرة أيام من اليوم التالي لتاريخ
صدوره أو تبلغه، حسب مقتضى الحال وعلى محكمة الاستئناف البت في الاستئناف خلال مدة
عشرة ايام من تاريخ وروده لها ويكون قرارها في هذا الشأن قطعيا.
