Article text
أ- عند انتهاء تنفيذ خطة إعادة التنظيم على المدين أن يتقدم بطلب الى المحكمة لإصدار قرار
انتهاء تنفيذ الخطة على أن يرفق بطلبه ما يثبت الالتزام بالشروط المتفق عليها في خطة إعادة
التنظيم .
( ب- يتم نشر قرار المحكمة بإعلان انتهاء تنفيذ المدين للخطة وفقاً لأحكام المادة 139 ) من هذا
القانون ولكل ذي مصلحة أن يعترض خطيا خلال مدة عشرة أيام من تاريخ نشر القــرار.
ج- إذا قدم اعتراض على قرار المحكمة وفقا لأحكام الفقرة (ب) من هذه المادة تستمع المحكمة
لأقوال المدين والمشرف على تنفيذ خطة إعادة التنظيم وتتخذ قرارا خلال مدة خمسة أيام من
تقديم الاعتراض إما بانتهاء تنفيذ خطة إعادة التنظيم بالكامل أو ببدء إجراءات التصفية.
د- يكون قرار البت في الاعتراض الصادر عن المحكمة قابلا للاستئناف خلال مدة عشرة أيام من
اليوم التالي لصدوره أو تبلغه حسب مقتضى الحال.
