Article text
أ- يلزم المدين بتقديم طلب الى المحكمة للبدء بإجراءات التصفية في أي من الحالات التالية:-
اذا وجد أن النشاط الاقتصادي غير مجد.
عدم إمكانية وضع خطة اعادة تنظيم .
عدم قدرته على الالتزام بتنفيذ خطة إعادة التنظيم .
ب- في جميع الأحوال للمدين أن يطلب التصفية في أي وقت خلال السير بإجراءات الإعسار.
ج- يترتب على إخلال المدين بواجبه المنصوص عليه في الفقرة (أ) من هذه المادة الأثر ذاته الذي
يترتب على إخلاله بواجب التقدم بطلب إشهار الإعسار.
د- تقرر المحكمة خلال مدة عشرة أيام من تاريخ تقديم طلب المدين بدء مرحلة التصفية ولها أن
تستمع لأقوال وكيل الإعسار ولجنة الدائنين إن وجدت قبل البت في الطلب.
هـ- يلتزم وكيل الإعسار بتقديم طلب الى المحكمة للبدء بإجراءات التصفية إذا توقف النشاط
الاقتصادي أو إذا لم تتوافر أسباب موضوعية لتوقع الموافقة على خطة إعادة التنظيم وعلى
المحكمة أن تستمع لأقوال المدين ولجنة الدائنين، إن وجدت، قبل إصدار قرارها.
و- إذا كان بدء مرحلة التصفية ناجما عن عدم الالتزام في تنفيذ خطة إعادة التنظيم تكلف
المحكمة وكيل الإعسار ليتولى أعمال التصفية، ما لم تقرر المحكمة تعيين وكيل إعسار آخر.
( ز- يتم إشهار قرار بدء مرحلة التصفية بالطرق المنصوص عليها في المادة 139 ) من هذا القانون.
