1 - لا تكون الدفاتر والاوراق الخاصة حجة لمن صدرت عنه.
2 -: - ولكنها تكون حجة عليه
. أ- إذا ذكر فيها صراحة أنه استوفى ديناً
ب- اذا ذكر فيها صراحة أنه قصد بما دونه في هذه الأوراق أن تقوم مقام السند لمن أثبتت حقاً
لمصلحته.
