وجود ادعاءات متضاربة على علامات تجاریة متشابھة
المادة 17 -
اذا طلب عدة اشخاص تسجیل علامات تجاریة متماثلة او قریبة الشبھ بعضھا ببعض وكانت تلك العلامات تتعلق بنفس
البضائع
او الصنف ، فیجوز للمسجل أن یرفض تسجیل أیة علامة من تلك العلامات باسم شخص من ھؤلاء الطالبین إلا بعد أن
تسوى حقوقھم.
1 - اما بالاتفاق فیما بینھم على وجھ یوافق علیھ المسجل، او
2 . - بواسطة محكمة العدل العلیا التي یحیل المسجل الخلاف علیھا عند عدم الوصول الى مثل ھذا الاتفاق
