Article text
أ - يعاقب بالأشغال المؤقتة مدة لا تقل عن خمس سنوات وبغرامة لا تقل عن خمسة آلاف دينار
كل من روج المواد المخدرة أو المؤثرات العقلية أو المستحضرات او توسط في ترويجها بأي صورة
أو وسيلة كانت.
ب- يعاقب بالأشغال المؤقتة مدة لا تقل عن عشر سنوات وغرامة لا تقل عن عشرة آلاف دينار كل
من ارتكب الجريمة المنصوص عليها في الفقرة (أ) من هذه المادة بالاشتراك مع قاصر او
استخدم قاصرا في ارتكابها او كان الشخص الذي روجت إليه المادة المخدرة او المؤثر العقلي او
المستحضر قاصرا.
ج- لا يجوز للمحكمة الأخذ بالأسباب المخففة التقديرية في حالة التكرار.
