للمؤلف التصرف في اي من حقوقه المالية في المصنف على اساس المشاركة مع الغير بنسبة
من الايراد او الربح الناتج عن الاستغلال
المالي للمصنف من قبل ذلك الغير. و يشترط في ذلك ان يكون له الحق في الحصول على جزء
اضافي من ذلك الايراد او الريع
اذا تبين ان الاتفاق على استغلال مصنفه لم يكن عادلا بحقه ، او اصبح كذلك لظروف واسباب
كانت خافية وقت التعاقد او
طرأت بعد ذلك.
