( أ- مع مراعاة أحكام البند 1 ) ( من الفقرة )جـ( من المادة 100 ) من القانون على وكيل الإعسار البدء
بإجراءات بيع الأموال المثقلة بالحقوق العينية في موعد لا يتجاوز شهرين من تاريخ اعتماد خطة
( التصفية من المحكمة وفقاً لأحكام الفقرة )ج( من المادة 101 ) من القانون وللمحكمة تمديد
المدة بناء على طلب وكيل الإعسار لمدة مماثلة ولمرة واحدة فقط.
ب- لا يتم بيع الأموال التي هي موضوع طلب فصل عن ذمة الاعسار وفقا للإجراءات المحددة
( في المادة 42 ) من القانون ما لم يتم البت في الطلب، ويبدأ احتساب المدة المنصوص عليها
في الفقرة (أ) من هذه المادة من تاريخ صيرورة قرار المحكمة بخصوص رفض طلب الفصل
نهائيا.
