الفصل السادس
الرجوع بعدم سبب الوفاء
1 - لحامل الشيك الرجوع على المظهرين والساحب وغيرهم من الملتزمين به اذا قدمه في
الوقت المحدد ولم تدفع قيمته واثبت
الامتناع عن الوفاء باحدى الطرق الآتية:-
أ- بورقة احتجاج رسمية.
ب- ببيان صادر من المسحوب عليه مؤرخ مكتوب على ذات الشيك مع ذكر يوم تقديمه.
ج- ببيان مؤرخ صادر من غرفة المقاصة يذكر فيه ان الشيك قدم في الوقت المحدد و لم تدفع
. قيمته
2 - ويطلق لفظ احتجاج ايضاَ في هذا القانون على البيانين المذكورين في الحالتين الواردتين
( في الفقرتين) ب و ج
من هذه المادة الا اذا نص على خلاف ذلك.
