1 - اذا خالف المدين احكام المادتين السابقتين او ثبت انه اخفى قسما من موجوداته او اهمل
عن حيلة
ذكر بعض الدائنين او اذا ارتكب بوجه عام حيلة ما 0 فالقاضي المنتدب يرفع الامر الى المحكمة
وهذه تقرر شهر الأفلاس.
2 - ولا يحول ذلك دون العقوبات الجزائية التي استهدف لها التاجر.
