اذا تبين للمحكمة عند غياب المدعى عليه بطلان تبليغه لائحة الدعوى وجب عليها تأجيل الدعوى
الى جلسة تالية يعاد تبليغه
اللائحة تبليغا صحيحا.
واذا تبين لها عند غياب المدعي عدم علمه بالجلسة قانونا وجب عليها تأجيل الدعوى إلى جلسة
تالية تبلغه بها.
