Article text
الاختصـــــاص
أ- يكون الاختصاص المكاني لدائرة التنفيذ وفقا لما يلي:-
1 - الدائرة التي توجد في منطقة المحكمة التي أصدرت الحكم أو موطن المحكوم عليه أو
. موطن المحكوم له فيما يتعلق بتنفيذ الأحكام
2 - الدائرة التي تمّ إنشاء السندات التنفيذية الرسمية أو تصديقها في منطقتها.
3 - الدائرة التي يكون موطن المدين أو أمواله أو اشتراط الوفاء فيها أو تم إنشاء السندات
. العادية أو الأوراق التجارية في منطقتها
ب -اذا اقتضى التنفيذ اتخاذ تدابير خارج منطقة الدائرة فللرئيس إنابة الدائرة التي ستتخذ فيها التدابير
التنفيذية .
ج- إذا تعددت الدوائر المختصة بتنفيذ السند التنفيذي الواحد فينعقد الاختصاص للدائرة التي
قُدّم إليها الطلب أولاً.
