Article text
أ- إذا استنكف المزايدُ المحالُ عليه المال غير المنقول إحالةً قطعية عن تأدية بدل المزايدة كاملاً
خلال ثلاثة أيام من تاريخ إخطاره بالدفع يعرض العقار على المزايد الذي يليه بالبدَل الذي قدمه،
وفي حال موافقته خلال ثلاثة أيام من تاريخ إخطاره، فيُحال عليه المال غير المنقول على أن
يتحمل المزايدُ المستنكِفُ الفرقَ بين البدَلين ويُحْسَم من العربون، فإذا لم يَكْفِ تنفّذ الدائرة
على أمواله الأخرى بقرارٍ من الرئيس دون الحاجة للحصول على حكم قضائي.
ب- في حال عدم موافقة المزايد التالي على الشراء خلال ثلاثة أيام من تاريخ إخطاره بذلك،
فيقرر الرئيس إعادة المزايدة لمدة خمسة عشر يوماً وتجري إحالته قطعياً على المزايد الأخير
بالبدَل الأعلى، ويضم َّن المستنكِفُ الأولُ الفرقَ وفق أحكام الفقرة (أ) من هذه المادة.
