Article text
أ- للنيابة العامة الشرعية الطعن بالحكم في الأحوال التي يوجب القانون أو يجيز تدخلها فيها
اذا خالف الحكم قاعدة من قواعد النظام العام أو القانون.
ب- للنائب العام الشرعي ان يطعن أمام المحكمة العليا الشرعية لمصلحة القانون في
الأحكام القطعية أيا كانت المحكمة التي أصدرتها إذا كان الحكم مبنياً على مخالفة للقانون أو
خطأ في تطبيقه أو تأويله وذلك في الأحوال التالية:-
1 - الأحكام التي لا يجيز القانون للخصوم الطعن فيها.
2 - الأحكام التي انقضى ميعاد الطعن فيها بسبب الخصوم أو تنازلوا عن الطعن فيها أو رفعوا
طعناً فيها قضي بعدم قبوله . شكلاً
ج- يرفع الطعن المنصوص عليه في الفقرة(ب) من هذه المادة خلال سنة من تاريخ صدور الحكم
بلائحة يوقعها النائب العام الشرعي وتنظر في الطعن دون دعوة الخصوم ولا يستفيد الخصوم
من هذا الطعن.
