Article text
أ- للمحكمة قبل البت في طلب الاعتراف و بناء على طلب وكيل الإعسار الأجنبي أن تمنح
مساعدة مؤقتة بشكل مستعجل لغايات اتخاذ الإجراءات اللازمة لحماية أموال المدين أو مصلحة
الدائنين بما في ذلك مـــا يلي:-
1 - أن توقف التنفيذ على أموال المدين.
2 - أن تعهد الى وكيل الإعسار الأجنبي أو أي وكيل إعسار مؤقت بعملية إدارة وتحصيل أموال
المدين الموجودة في المملكة كليا أو جزئيا بهدف حماية تلك الأموال والمحافظة على قيمتها
بسبب طبيعتها أو لأي ظروف أخرى.
3 ( - أن تمنح أي مساعدة منصوص عليها في البندين 2 ) ( و 4 ) ( من الفقرة )أ( من المادة 126 ) من
. هذا القانون
ب- للمحكمة أن ترد طلب منح المساعدة بموجب هذه المادة إذا رأت أن من شأن قبول الطلب
التدخل في سير إجراءات الإعسار الرئيسة الأجنبية.
( ج- مع مراعاة أحكام المادة 126 ) من هذا القانون ينتهي أثر قرار منح المساعدة بموجب أحكام
هذه المادة عند البت بطلب الاعتراف.
