Article text
أ- دون الإخلال بالحق في طلب إشهار الإعسار وفقاً لأحكام هذا القانون يترتب على الاعتراف
بالإجراءات الأجنبية الرئيسة ما يلي:-
1 - عدم قبول الدعاوى أو الإجراءات الفردية المتعلقة بأموال المدين أو حقوقه أو التزاماته أو
مسؤولياته أو الاستمرار فيها باستثناء الدعاوى أو أي إجراءات فردية يقيمها أي شخص للمدى
اللازم لحماية حقوقه في مواجهة المدين.
2 - وقف التنفيذ على أموال المدين.
3 - وقف الحق في التصرف بأي أموال عائدة للمدين أو إثقالها بحقوق أو التصرف فيها بأي شكل
. آخر إلا فيما يخص تسيير أعماله المعتادة
ب- تراعي المحكمة عند اتخاذ الإجراءات المنصوص عليها في الفقرة (أ) من هذه المادة توفير
الحماية الكافية لمصالح مواطني المملكة في الإجراءات الأجنبية الرئيسة.
