Article text
أ- تضمن المحكمة قرار إشهار الإعسار
استحقاق أتعاب متغيرة لوكيل الإعسار تعتمد
على تحقيق نتيجة على ان تسدد عند انتهاء
اجراءات الاعسار.
ب- تحدد المحكمة قيمة الأتعاب المتغيرة
المستحقة لوكيل الاعسار عند انتهاء إجراءات
الاعسار بناءً على المبالغ التي تم استردادها
لصالح ذمة الاعسار من خلال إجراءات عدم نفاذ
التصرفات المقامة وفقاً لأحكام القانون او
المبالغ المحصلة بموجب احكام صادرة
بالمسؤولية الشخصية لمديري المدين، إذا
كان شخصاً اعتبارياً.
ج- في الأحوال كافة لا يجوز أن تتجاوز أتعاب وكيل الإعسار
( المتغيرة التي تعتمد على تحقيق نتيجة ما نسبته 10 ) %
من صافي المبالغ المحصلة.
