Article text
أ- إذا كان المال المراد بيعه بالتفاوض المباشر مع المشتري مثقلاً بحق عيني،
فيحق لصاحب الحق العيني أن يتقدم بطلب لشرائه إلى المحكمة أو إلى
وكيل الإعسار بالسعر المعروض أو بسعر أفضل إما مباشرة أو من خلال حليف
له، إذا كان شخصاً اعتبارياً.
ب- إذا كان عرض الشراء المقدم وفقا لأحكام الفقرة (أ) من هذه المادة
مكتملاً فيتم بيع المال موضوع الطلب لصاحب الحق العيني أو حليفه، حسب
مقتضى الحال وله إجراء التقاص بين الحق المضمون بالمال الذي اشتراه
وحصيلة البيع.
