للمحكمة بناء على طلب وكيل الاعسار، وبعد الاستماع
لأقوال المدين ولجنة الدائنين، إن وجدت:-
أ- أن تسمح لوكيل الإعسار بالتنازل عن أي أموال أو حقوق
عائدة لذمة الإعسار لصالح الخزينة أو أي مؤسسة عامة أو
جمعية خيرية عند تعذر بيعها أو إذا كان في بيعها ضرراً
لذمة الإعسار.
ب- ان تقرر شطب الديون والذمم المتعذر تحصيلها او
التي تزيد كلفة تحصيلها على قيمتها.
