( أ- مع مراعاة أحكام الفقرة )ج( من المادة 59 ) من
القانون، على وكيل الإعسار تقديم طلب خطي إلى
المحكمة قبل بيع الأموال المعرضة للتلف أو لنقصان
القيمة دون مراعاة الإجراءات المنصوص عليها في هذا
الفصل.
ب- على المحكمة إصدار قرار بخصوص الطلب المقدم
وفقاً لأحكام الفقرة (أ) من هذه المادة خلال مدة لا تتجاوز
يوما واحدا من تاريخ تقديمه وفي حال عدم إصدار القرار
فلوكيل الإعسار السير في إجراءات البيع .
